According to the Australian Tax Office (ATO) rules, if gifts are given to a former or current client with the aim of producing assessable income in the future, then they are tax deductible. However, some types of client gifts aren’t tax deductible, like event tickets or gifts of personal nature. 

Nevertheless, we highly recommend that you seek advice and/ or consult your accountant or a qualified tax professional before finalising your decision. 

Keep in mind that not all client gifts are tax deductible. Among these are tickets (theatre/ sporting) and gifts of a personal nature. Below are examples of both instances:

Tax Deductible: If you have a renovation business and decide to gift a bottle of champagne to a client who had a property renovated by your business in the past 12 months, then the gift was most likely sent to keep the client loyal to you and/or encourage the client to refer your business to their peers. Even if you get along well with your client, the gift was not sent for personal reasons and as such, the expense you have incurred for purchasing the champagne is not of capital nature (an expenditure on a long-term asset) which deems it eligible for a tax deduction.

Not Tax Deductible: If you had a business that sells small garden statues, and you sold one to your sibling/relative for $250, and subsequently gift him a bottle of champagne worth $170, and it was known that you previously only provided gifts to clients who have spent more than $2,500 in the past year, then the gift is deemed made for personal reasons and will not be eligible for a tax deduction.

Yes, so long as the client gift is not classed under entertainment, GST can be claimed and it is eligible for tax deductions. Under ATO regulations, entertainment refers to the following:

  • food, drink, or recreation (recreation includes amusement, sports, and other similar activities such as movie tickets, cruise, golf game, etc.)
  • providing accommodation and/ or travel in connection with such entertainment

Keep in mind that it is possible to claim GST and tax deductions for Christmas gifts sent to employees and their families provided that it satisfies the following criteria:

  • a one-off gift, defined as ‘infrequent’
  • does not belong to the class of gifts under entertainment
  • costs less than $300, inclusive of GST

If the Christmas gifts are going to be sent to contractors, suppliers, and/ or clients, then it only needs to not be classed as entertainment to deem it eligible for GST and tax deductions.
